Terms & Conditions of Sale
Mississippi Roots, LLC. Please review carefully — registering to bid constitutes acceptance of all terms below.
1. Bidder Agreement & Binding Contract
- Binding Terms: By registering, bidding, or participating in an auction, you agree to be bound by these Terms and Conditions, alongside any other rules or announcements posted on this site.
- Legal Effect: Internet bids carry the exact same legal weight and obligations as if the bidder were present at a live, in-person auction.
- All Sales Final: All sales are final. No refunds, credits, or adjustments will be issued unless expressly noted.
- Inquiries: Please ask all questions regarding items prior to placing a bid.
2. “As-Is, Where-Is” Disclaimers & Item Descriptions
- No Warranties: All property is sold as-is, where-is with all faults. Mississippi Roots, LLC and its clients expressly disclaim all warranties, express or implied, including the implied warranties of merchantability and fitness for a particular purpose.
- Buyer’s Responsibility: Item descriptions and photos are intended solely as a guide. Mississippi Roots, LLC does not guarantee the accuracy of descriptions, appraisals, gradings, or certifications. Bidders are the sole judges of an item’s condition, age, genuineness, value, and legality in their jurisdiction.
- No Live Previews: Live previews are not available. By bidding, you acknowledge that you either inspected the items via provided media to your satisfaction or voluntarily chose not to examine them at your own risk.
- Errors & Omissions: Mississippi Roots, LLC is not responsible for any errors or omissions in advertising or catalog descriptions unless they constitute material, intentional misrepresentations.
3. Payment Terms & Deadlines
- Payment Deadline: All purchases must be paid in full by 4:00 PM Central Time on the Tuesday immediately following the auction.
- Credit Card Processing: Mississippi Roots, LLC reserves the right to charge your registered credit card for the full amount of your winning bids at any time after the auction closes. Any unpaid invoices after the 4:00 PM Tuesday deadline will automatically be billed to your registered card.
- Returned Checks & Late Fees: Returned checks will be re-presented electronically, and the buyer will be charged the maximum service fees and interest allowed under Mississippi law.
- No Chargebacks: Bidders strictly agree not to initiate credit card chargebacks or stop-payments on any checks for any reason.
- Sales Tax: Applicable state and local sales tax will be collected on all purchases. To be tax-exempt, you must provide a valid copy of your Sales Tax Exemption Certificate prior to payment; otherwise, taxes will apply.
- Transfer of Title: Title to the merchandise passes to the bidder only after secure payment has been received and verified in full.
4. Removal, Shipping, & Storage Fees
- Pickup Location & Hours: Items must be picked up at 12437 Raintree Pl., Biloxi, MS 39532 on the Monday or Tuesday (10:00 AM – 4:00 PM) following the auction close.
- Load-Out: Buyers must bring all necessary loading labor, tools, boxes, and packing materials. Auction staff will assist with moving items outside but are not responsible for loading items.
- Forfeiture & Abandonment: Items not picked up by 6:00 PM on Tuesday will be considered forfeited without refund, unless prior arrangements were made. Any item left past the scheduled pickup window will incur a $25.00 per day storage fee. Once storage fees exceed the purchase price, the item is deemed abandoned and becomes the property of Mississippi Roots, LLC.
- Shipping Terms: Standard shipping for small items (minimum $50.00 invoice) may be arranged at the buyer’s expense. Shipping costs include actual carrier fees plus a $2.00 to $25.00 packing fee per box. Allow 7–10 business days for processing. All packages are shipped insured with a signature requirement. Mississippi Roots, LLC is not liable for shipping damages; buyers must file claims directly with the carrier.
5. Special Provisions for Vehicles & Firearms
- Motorized & Titled Vehicles: Sold strictly as-is, tow-away. No emissions or mechanical tests are guaranteed or provided unless explicitly stated in the item description. It is the buyer’s sole responsibility to ensure the vehicle can legally be registered in their jurisdiction.
- Firearms & Weapons: All local, state, and federal laws apply.
- Buyers must present proper government-issued ID, pass a background check, and successfully complete ATF Form 4473 and a company liability waiver.
- Non-compliant magazines or accessories illegal in the buyer’s area are excluded from the sale without credit.
- Failed Background Checks / Illegal Returns: If a buyer cannot legally take delivery of a firearm due to background check failure or local restrictions, the firearm will be returned to Mississippi Roots, LLC and resold at absolute auction subject to a 25% consignment commission charge.
6. No-Show Penalty
- Failure to pick up or communicate regarding won items will result in the immediate revocation of your bidding privileges for all future auctions. To reinstate privileges, you must pay a penalty equal to the lost company commission on the abandoned items.
7. Online Platform Disclaimer & Auction Operations
- Technology Disclaimers: Mississippi Roots, LLC provides online bidding as available and is not responsible for internet disruptions, software glitches, dropped connections, or missed bids. Bidders are encouraged to place maximum bids at least two hours before closing.
- Auctioneer Rights: The auctioneer reserves the right to withdraw, re-catalog, or reject any bid for any reason. In the event of a technical error, Mississippi Roots, LLC may extend, pause, restart, or cancel an auction.
- Final Certification: A display of “Sold” online does not constitute a final sale. Sales are only final once certified by Mississippi Roots, LLC via an official invoice.
- Permitted Bidders: This is a public auction; all qualified bidders — including owners, family members, employees, and clients of Mississippi Roots, LLC — may bid. Sellers may bid on their own items only up to the amount of an established reserve price.
8. Site Safety & Risk of Loss
- Risk of Loss: The buyer assumes full responsibility and risk of loss for all purchased items the moment the auction closes or auctioneer declares the item “sold.” Buyers must maintain their own liability insurance as required by law.
- Premises Hazard: The auction pickup and preview sites are potentially dangerous environments (heavy machinery, live electrical circuits, active loading, etc.). All persons visit the site entirely at their own risk. Mississippi Roots, LLC, its agents, and its clients are completely released from liability for any property damage, personal injury, or death occurring on the premises.
9. Governing Law, Venue, & Binding Arbitration
- Jurisdiction: This agreement is governed by the laws of the State of Mississippi. Bidders consent to personal jurisdiction and venue in Harrison County, Mississippi. Service of process may be obtained via certified mail to the registration address provided.
- Binding Arbitration: In the event of any dispute arising between Mississippi Roots, LLC and a bidder, the bidder waives the right to a trial or court hearing and agrees to settle the matter through binding arbitration in Harrison County, MS. The arbitrator shall be appointed by the President of the Mississippi Auctioneers Association.
